Terms of Service

1. Acceptance of Terms

By accessing and using the services of Mint.bh ("Company," "we," "our," or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Services

Mint.bh provides luxury swimming pool construction, landscaping, and related services in Bahrain. Our services include but are not limited to:

• Custom pool design and construction
• Landscape architecture and installation
• Pool maintenance and renovation
• Consultation and project management

3. Project Agreements

Each project will be governed by a separate written agreement that outlines specific terms, scope of work, timeline, and payment schedule. These project-specific agreements will supplement these general Terms of Service.

4. Consultation and Quotes

Initial consultations may be provided free of charge at our discretion. Detailed design proposals and quotes are valid for 30 days unless otherwise specified. Prices are subject to change based on material costs and project scope modifications.

5. Payment Terms

Payment Schedule

Unless otherwise agreed in writing:

• Initial deposit: 30% upon contract signing
• Progress payments: As specified in project agreement
• Final payment: Upon project completion

Late Payments

Late payments may incur charges as specified in the project agreement. We reserve the right to suspend work for overdue accounts.

6. Client Responsibilities

Clients agree to:

• Provide accurate property information and access
• Obtain necessary permits and approvals
• Make timely decisions on design and materials
• Ensure site readiness as specified
• Make payments according to agreed schedule

7. Warranties and Guarantees

We provide warranties on our workmanship as specified in individual project agreements. Equipment and material warranties are provided by respective manufacturers. Warranty terms and conditions will be detailed in your project agreement.

8. Limitation of Liability

To the maximum extent permitted by law, Mint.bh shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

9. Intellectual Property

All designs, plans, and specifications created by Mint.bh remain our intellectual property unless otherwise agreed in writing. Clients receive a license to use these materials solely for the agreed project.

10. Force Majeure

Neither party shall be liable for any failure or delay in performing their obligations if such failure or delay results from circumstances beyond reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

11. Cancellation Policy

Cancellation terms will be specified in individual project agreements. Generally, deposits are non-refundable, and cancellation may result in payment for work completed and materials ordered.

12. Dispute Resolution

Any disputes arising from these terms or our services shall first be addressed through good faith negotiation. If resolution cannot be reached, disputes shall be resolved through arbitration in accordance with the laws of the Kingdom of Bahrain.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Kingdom of Bahrain, without regard to its conflict of law provisions.

14. Indemnification

You agree to defend, indemnify, and hold harmless Mint.bh and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms of Service.

15. Privacy

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the site and informs users of our data collection practices.

16. Severability

If any provision of these Terms of Service is held to be invalid or unenforceable by a court, the remaining provisions of these Terms of Service will remain in effect.

17. Changes to Terms

We reserve the right to modify these terms at any time. We will notify clients of any material changes. Your continued use of our services following the posting of revised terms means that you accept and agree to the changes.
